Information on Withdrawal

Right of Withdrawal

You have the right to withdraw from this agreement within 30 days without giving any reason.

The withdrawal period is 30 days from the date on which:

• you, or a third party designated by you who is not the carrier, have taken possession of the goods, insofar as you ordered one or more goods under one order and these have been delivered simultaneously;
• you, or a third party designated by you who is not the carrier, have taken possession of the last goods, insofar as you ordered several goods under one order and these were delivered separately.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this agreement. This can be done by e-mail: support@kik-auckland.com.
You may use the attached model withdrawal form for this purpose, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this agreement, we shall refund to you all payments received from you, including delivery costs (except for additional costs resulting from your choice of a different type of delivery than the standard delivery offered by us), immediately and at the latest within 30 days from the date on which we received your notice of withdrawal.

For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise. In no case will this refund incur additional costs for you.

We may withhold reimbursement until we have:

• received the returned goods, or
• you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any event no later than 30 days from the day on which you informed us of the withdrawal from the contract. The deadline is met if you send the goods back before the expiry of the period of 30 days.

The direct costs of returning the goods shall be borne by you.

You are only liable for any diminished value of the goods resulting from handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Reasons for Exclusion and Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

• for the supply of goods which are not prefabricated and which are made on the basis of an individual choice or decision of the consumer;
• for the supply of goods which may spoil quickly or have a limited shelf life;
• for the supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the contract, but which can only be delivered at the earliest 30 days after the conclusion of the contract and the actual value of which depends on market fluctuations;
• for the supply of newspapers, periodicals or magazines, with the exception of subscriptions.

The right of withdrawal expires prematurely for contracts:

• for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if the seal has been broken after delivery;
• for the supply of goods which, after delivery, are inseparably mixed with other goods due to their nature;
• for the supply of audio and video recordings and computer software in a sealed package, if the seal has been broken after delivery.
